What it is like if you are sued!

Being sued can constitute a living Hell.

Instead of marketing and otherwise running your business, you get to worry about whether it, you, and, relatedly, reputations will be significantly damaged.

Even if you are insured, your policy may well be cancelled after any settlement or an adverse jury or judge verdict. - and you will not be insured for, for example, punitive damages.

If you are not insured, you get to pay legal fees, expert witness fees, deposition reporter costs, filing fees, etc. - which can total many thousands of dollars.

If you lose your case, you will likely have to pay specified “costs” of the other side, including filing fees and deposition costs - which can quickly total into the 4 figures - or more. Moreover, many statutes and contracts provide that attorney fees of the winner be paid by a loser.

If your occupation depends upon your having insurance, you may lose your livelihood. (A horror story: Recently, the malpractice insurance policy of a physician friend was cancelled after his insurer recommended that he settle a lawsuit against him to avoid the potential adverse consequences of a jury trial - including a greater potential cost to the insurer. Both the physician and his insurer considered the suit, which alleged malpractice, to be without merit. Nonetheless, the insurer cancelled the physician’s policy soon after the very settlement it urged - which meant the physician could no longer send patients to the hospital with which his practice was associated, because physicians on the staff of that hospital were, as is typical, required to have malpractice insurance. The physician could not get coverage from any other insurance company, because his company was the only company offering malpractice insurance policies in his state. To maintain health care coverage for his employees, family, and self, he was also required to carry malpractice insurance. To his further horror, false rumors began circulating in his community that he had lost his medical license - not just his malpractice insurance - which, of course, was not the case! Not all litigation can be prevented - but some of it can - raising the question of whether he could have done anything differently to prevent his feeling like a victim.)

Whether you win or lose a lawsuit will typically be a “crap shoot,” because being in a lawsuit is very much akin to gambling in Los Vegas. Indeed, whether you win or lose will often be a question of whether a jury or judge likes you more than your opposition, especially in close cases.
